Terms of Service

These Terms of Service (“Terms”) govern your access to and use of EdgeAI Bets (the “Service”), a sports analytics product operated by XIK Labs, based in Orange, California (“we,” “us,” or “our”). By creating an account or using the Service you agree to these Terms.

1. Acceptance of Terms

By accessing the Service, creating an account, or clicking “Subscribe,” you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service Is (and Isn’t)

The Service provides AI-assisted sports betting analytics, including cross-book odds comparison, expected-value (EV) grading, player game log analysis, and personal P&L tracking. We are not a sportsbook. We do not accept, place, or settle wagers. We do not hold funds for the purpose of wagering, and we do not act as an agent for any sportsbook.

Information on the Service may be incomplete, delayed, or inaccurate. We make no representations about the timeliness, completeness, or reliability of any data displayed.

3. Eligibility

To use the Service you must:

• Be at least 18 years old, or the age of majority in your jurisdiction, whichever is older;
• Be at least 21 years old if you reside in or access the Service from a jurisdiction that requires that age for legal sports wagering;
• Reside in a jurisdiction where receiving sports analytics information is permitted; and
• Not be on any self-exclusion list maintained by a regulator or sportsbook.

It is your responsibility to determine whether your use of the Service is lawful in your location. We may restrict access from certain jurisdictions at our discretion.

4. Responsible Gambling

Gambling can be addictive and can cause serious personal, financial, and family harm. Do not use this Service if you have a gambling problem, are in recovery from a gambling problem, or are at risk of developing one.

5. Subscriptions, Billing, and Cancellation

5.1 Plans and Pricing

The Pro plan is currently offered at $29 per month as a founding member rate. The standard price is $39 per month. Subscribers who join at the founding member rate will have their $29 rate locked in for as long as their subscription remains active and in good standing. New subscribers after the founding member period ends will be charged at the then-current rate. All amounts are charged in advance through Stripe in U.S. dollars and exclude applicable taxes.

5.2 Automatic Renewal (California ARL)

Your subscription automatically renews on the same day each month and will continue until you cancel. Each renewal will charge the payment method on file at the price then in effect for your plan.

5.3 How to Cancel

You may cancel at any time through the Billing page (which opens the Stripe Customer Portal) or by emailing support@xiklabs.com. Cancellation takes effect at the end of the current billing period; you retain access through that date.

5.4 Refunds

All sales are generally final. We may issue refunds at our sole discretion for verified technical issues or as required by applicable law. Contact support@xiklabs.com within 48 hours of a charge to request consideration.

5.5 Price Changes

We may change prices for any plan with at least seven (7) days’ notice before the change takes effect. Notice will be sent to your account email. If you do not agree to the new price, you may cancel before the change takes effect.

6. Acceptable Use

You agree not to:

• Scrape, crawl, mass-download, or otherwise extract our data or APIs by automated means;
• Resell, redistribute, sublicense, or republish content from the Service;
• Reverse engineer, decompile, or attempt to derive the source code of our models or software;
• Maintain more than one account per person;
• Use the Service from any jurisdiction where its use would be unlawful; or
• Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure.

7. Account Suspension and Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if continued access poses a risk to us, other users, or third parties. You may close your account at any time by canceling your subscription and emailing support@xiklabs.com to request deletion of your data.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall XIK Labs be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or related to your use of (or inability to use) the Service. Our total aggregate liability arising out of or relating to these Terms or the Service is limited to the amount you actually paid us for the Service in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless XIK Labs, its affiliates, and its principals from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) your wagering or other gambling activity, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party.

10. Dispute Resolution and Arbitration

Informal first. Before filing a claim, you agree to contact us at support@xiklabs.com and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. If we cannot resolve the dispute informally, you and XIK Labs agree to resolve it through final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The seat of arbitration is Orange County, California. Each party will bear its own costs except as otherwise allowed by law. Either party may seek injunctive relief in court for intellectual property or unauthorized access claims.

Class action waiver. Disputes will be resolved on an individual basis. You waive any right to participate in a class, consolidated, or representative action.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Subject to the arbitration provision above, the state and federal courts located in Orange County, California will have exclusive jurisdiction over any non-arbitrable dispute.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced by email or in-product notice at least seven (7) days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
